New amendments to the Audiovisual Media Services Code, passed at second reading

The draft law amending the Audiovisual Media Services Code was passed by Parliament in its second reading on Thursday, October 8. The legislative initiative was supported by 53 MPs from the Action and Solidarity Party and one MP from the Party of Socialists. As part of the same bill, Parliament approved an amendment to Law No. 174/2021 on the mechanism for screening investments of importance to state security, introducing a new legal concept: “imminent risk of irreparable harm.”
According to the report on the draft law, “the legislative initiative aims to update and harmonize the national regulatory framework with the European Union acquis in the field of audiovisual media services, strengthen regulatory and supervisory mechanisms, improve provisions concerning the protection of the audiovisual space, promote audiovisual content in the Romanian language, ensure the accessibility of media services for persons with disabilities, protect minors, develop non-linear audiovisual media services, encourage the broadcasting of European and domestic audiovisual productions, and regulate the activities of the regional public media service provider.”
The draft law was examined and passed in its first reading during the plenary session on August 25. At the time, Media Azi reported extensively on parliamentary debates concerning the provisions governing the activities of Gagauzia’s public media service provider.
The bill also provides for an amendment to the Law on the mechanism for assessing investments of significance to national security, introducing the new legal concept of “imminent risk of irreparable harm.” The introduction of this definition responds to recommendations made by experts from the Council of Europe and the European Commission, who highlighted the need for clear criteria for applying the restrictive measures provided for by law.
