The draft of the new media law<\/strong><\/a> was passed<\/strong><\/a> on Monday, 24 August, in its final reading by Parliament. The new law, which is aligned with European standards in this field, was adopted with the votes of 52 MPs and will replace the 1994 Press Law, which will be repealed upon the entry into force of <\/strong>the new provisions<\/strong><\/a>, that is, six months from the date of publication in the Official Gazette.<\/strong><\/p>\n

According to its sponsors, the law aims to establish a clear and coherent legal framework for the media sector, striking a balance between freedom of expression, editorial responsibility and the protection of media pluralism, in line with European standards and recent changes in the media market.<\/p>\n

The document introduces and clarifies a number of key concepts for the sector, including media pluralism, editorial responsibility, media service providers and concentrations in the media market. It also regulates the general principles applicable to media service providers and sets out their rights and obligations.<\/p>\n

Furthermore, the document provides for the creation of a register of transparency regarding the ownership and funding of media service providers, which will be administered by the Ministry of Culture. Registration will be voluntary and will not be a condition for carrying out activities in the sector.<\/p>\n

The provisions of the draft also include measures to protect journalistic activity and strengthen safeguards regarding editorial independence. These aim to prevent unjustified interference and ensure the conditions for the free exercise of the journalistic profession. The draft law also sets out criteria for assessing concentrations in the media services market, including with regard to their effects on media pluralism and editorial independence.<\/p>\n

\u201cThe new law aims to ensure the transparent, fair and democratic functioning of the media market in the Republic of Moldova and to contribute to strengthening society\u2019s informational resilience. The Ministry of Culture will be the central public authority responsible for developing and promoting public policies in the field of the media,\u201d states <\/a>the Parliament\u2019s press release.<\/p>\n

The draft<\/a> was drawn up by a group of MPs within the Committee on Culture, Education, Research, Youth, Sport and the Media, with the participation of members of the Civil Society Expert Council on the Media, as well as representatives of the Ministry of Culture and the Broadcasting Council.<\/p>\n

The document was submitted for consultation to the Venice Commission and the European Commission, and their recommendations were taken into account and incorporated into the text of the draft, according to the authors, alongside proposals arising from public consultations.<\/p>\n

Media Azi has previously reported<\/a> that the draft was submitted to Parliament in mid-April, with a new law being necessary given the significant developments in the sector in recent years. The Press Law, which remained in force until recently, was adopted in the early 1990s, when the media landscape was dominated by the print media.<\/p>\n
